Giveaway Rules

The following terms apply to the Golden Ticket Giveaway

• For the purposes of these Terms and Conditions, “The Promoter” refers to KAPITAN Wear GmbH. The “Prize” refers to one (1) “Golden Ticket”.
• The Prize allows the winner to enter one (1) Seiler and Speer concert of his or her choice for free. The winner will also be able to meet the band in person at this concert.
• Eligible are all customers of a KAPITAN “Sailor” Flat Cap who made their purchase before September 30th at 23:59.
• One (1) winner based in the EU will be selected at random by the Promoter on October 31st, 2024. The winner will be notified on or shortly after this date (within 3 days) via E-Mail and the Prize will be sent to an address of the winners choice.
• Each entrant shall enter the competition by purchasing a “Sailor” Flat Cap. This will award the entrant one lottery ticket. Purchasing multiple “Sailor” Flat Caps will not award the entrant additional lottery tickets.
• The Prize will be awarded to a randomly selected winner who has entered, using a random number generator.
• The name, address, email address and phone number of the winner must be provided to The Promoter if requested and will be shared with Seiler and Speer Management to enable fulfilment of the Prize.
• The winner’s name and social media username may be posted on the social media profiles of The Promotor after the winner has been selected.
• The Winner will receive the Prize by mail to a desired address after he has been contacted by the promoter via E-Mail.

The following terms apply to the Giveaway “personal delivery by Christopher Seiler”

• For the purposes of these Terms and Conditions, “The Promoter” refers to KAPITAN Wear GmbH. The “Prize” refers to one (1) “personal delivery and a meet and greet with Christopher Seiler”.
• Eligible are all customers of a KAPITAN “Sailor” Flat Cap.
• One (1) winner based in the EU will be selected at random by the Promoter based on their product box number. The Promoter already selected a number between 1 and 100 based on a random number generator. The customer whose numbered and signed product box matches this number will win the Prize. The Promoter will contact the Winner via E-Mail shortly after the purchase was finalised.
• Each entrant shall enter the competition by purchasing a “Sailor” Flat Cap. Purchasing multiple “Sailor” Flat Caps will increase the chance to win the Prize.
• To enable fulfilment of the Prize the winner will be contacted and told a location in Vienna. The Promoter will offer up to 3 different dates and times for the transfer of the Prize at that location. If none of these 3 dates are viable for the winner he forfeits the Prize.
• The winner may also forfeit the Prize for any other reason.
• If the Winner is not eligible or forfeits the Prize a new winner will be selected. A new unsold box number will be selected at random and the customer whose product box has the number will win the Prize instead. This procedure will repeat until a valid winner was found or no products are left in stock.
• The winner’s name and social media username may be posted on the social media profiles of The Promotor after the winner has been selected.
• Pictures and/or Videos that are made during the Prize transfer can be used by the Promoter and Christopher Seiler for any marketing purposes.

The following terms apply to both Giveaways

• Employees and relatives of The Promoter are not eligible to enter any giveaway.
• By entering the competition you agree to be bound by these terms and conditions.
• The Promoter will not be held liable if the named prize becomes unavailable or cannot be fulfilled.
• To the extent permitted by applicable law, The Promoter’s liability under or in connection with the competition or these terms and conditions shall be limited to the cost price of the Prize in question.
• To the extent permitted by applicable law, The Promoter shall not be liable under or in connection with these terms and conditions, the competition or any Prize for any indirect, special or consequential cost, expense, loss or damage suffered by a participant even if such cost, expense, loss or damage was reasonably foreseeable or might reasonably have been contemplated by the participant and the promoter and whether arising from breach of contract, tort, negligence, breach of statutory duty or otherwise.
• Prizes are non-negotiable, non-transferable and non-refundable. No cash alternative is available. Where a Prize becomes unavailable for any reason, the promoter reserves the right to substitute that prize for a prize of equal or higher value.
• In the event of unforeseen circumstances beyond The Promoter’s reasonable control, the promoter reserves the right to cancel, terminate, modify or suspend the competition or these terms and conditions, either in whole or in part, with or without notice.
• The Promoter’s decision is final.
